This is a widely held concern on the minds of workers who are injured and having problems but are reluctant to seek the advice of an attorney because they don’t want to “sue” their employer.  As an initial matter it is important to understand that a workers’ compensation claim is not a lawsuit.  Rather, it is a claim on insurance that your employer is required to have (assuming they regularly employ four or more people) and you are supposed to use when you get hurt on the job.  Remember – workers’ compensation is a “no-fault” system, meaning that you are never in a position of having to accuse your employer of doing something wrong.    

Further, when a lawyer gets involved, it does not transform a workers’ compensation claim into a lawsuit.  Instead, a lawyer representing you in a workers’ compensation claim is there to ensure that you are getting the treatment to which you are entitled, any weekly income replacement benefits (“temporary total” or “temporary partial” benefits) to which you are entitled, to secure an award that accurately reflects the magnitude of your injury/injuries, and to make sure your interests are protected in the future (particularly in terms of any possible future medical needs).  In short, the lawyer representing you in a workers’ compensation claim is not there to harm your employer, but rather to make sure you are protected and informed to obtain the best results possible for you–and your family.
