Who Can File a Wrongful Death Claim in South Carolina?
Every state has different laws regarding who is eligible to file a wrongful death claim. This right is generally reserved for the people who are closest to the deceased, or — as is the case in South Carolina — the executor of the victim’s estate. This person should be named in the decedent’s will, but a person can also be appointed to file the wrongful death claim by the court if there is no existing will or if the named executor is unable to file the claim.
