Ring in a safe New Year

Although midnight between New Year’s Eve and New Year’s Day is often celebrated by toasting with champagne, I urge you to please exercise caution and restraint on the roadways. There is often temptation to celebrate excessively by consuming too much alcohol. If you are involved in a collision this weekend, or at any time, and the at-fault driver is charged with driving under the influence, you may be eligible to pursue a personal injury claim. Injuries suffered in a DUI related collision can result in a successful personal injury case. A case may be prosecuted against the at-fault driver, his insurance company and potentially against any business that provided the alcohol. If a business over-served the driver, this could be recognized as a potential dram shop case. Prior to 2018, businesses permitted to sell alcoholic beverages for on-premises consumption were not required to purchase liability insurance. However, legislation was passed recently that now requires any business that is licensed or permitted to sell alcoholic beverages for on-premises consumption, which remains open after five o’clock p.m. to sell alcoholic beverages for on-premises consumption to carry liability insurance. This insurance benefits individuals and families who are the victims of injuries and/or have a wrongful death claim due to DUI. For more information, click here.

At KD Trial Lawyers, we have experience in investigating and prosecuting dram shop and DUI cases. Please be aware that if you or someone you know are involved in a collision you should initiate an investigation as soon as possible. Prompt action can preserve evidence to prosecute these cases.

In particular, please be cautious on the roadway this weekend and any time while driving a vehicle. If you notice signs of a drunk driver, you should contact law enforcement and proceed with caution. Your safety is the top priority, and contacting law enforcement can potentially save lives.
