Who Can File a Wrongful Death Claim in South Carolina?
Every state has different laws regarding who is eligible to file a wrongful death claim. This right is generally reserved for the people who are closest to the deceased, or — as is the case in South Carolina — the personal representative of the victim’s estate. This person should be named in the decedent’s will, but a person can also be appointed to file the wrongful death claim by the court if there is no existing will or if the named personal representative is unable to file the claim.
The damages recovered through a wrongful death claim will not go to the personal representative of the estate (unless that person is an heir of the deceased person). Compensation is generally provided to the victim’s spouse and children. If the decedent was not married or did not have children at the time of their death, the claim will provide compensation to their parents or other heirs.
