What is the Statute of Limitations in South Carolina for Personal Injury?

In South Carolina, the statute of limitations for personal injury claims is three years. The clock starts when the victim is injured. You can lose your right to legal action if you miss the deadline. 

There are some exceptions to the three-year statute of limitations: 

  • Suppose an injury is not discovered right away. In that case, the statute of limitations only starts to run when finding the injury.
  • A patient may bring suit within six years of a medical error if the error was not discovered during the standard two or three-year period and other conditions.
  • If the injured person is a minor, that person will extend the limitations period until one year after they turn 18.
  • If an individual is declared “insane,” the limitations period is extended until one year after they are no longer considered “insane.”
